Special Issue Information

Dear Colleagues,

The trade-off between preservation of the environment and objectives of economic development utilizing resources, or effecting the environment, lies at the core of sustainability issues. There is a complex mix of economic, legal, and environmental consequences from damages to real property because of environmental contamination sourced through the air, water, or land. Each country, and also within each country, can have their own laws and procedures to pursue compensation and address responsibility for the environment. There is also a body of case law and peer-reviewed literature in some nations that can inform as to expected outcomes.

Given that there is no method or legal process that can be applied in all jurisdictions or countries to achieve sustainability (by internalizing the negative externality through litigation or other means) after a contamination event, this Special Issue aims to gather diverse views, case studies, and methods for a framework of accessing environmental damages.

In particular, this Special Issue, on “Environmental Damages: Real Property Evidence and the Legal Environment Worldwide” invites theoretical and empirical research articles on the following main themes, although other relevant topics will also be considered:

  • Methodology to measure property damages
  • Environmental damage studies from around the world
  • Legal reviews of toxic tort damage methods and process from around the world.
  • The sustainability of property after a measurement of a contamination event.
  • Cases that exemplify how damage measurement and the legal process occurs within a country.
  • How property ownership and information effects environmental toxic tort cases.
  • How sustainability is effected by court case decisions or outcomes.
  • Disaster and emergency response to contamination events in sustainable cities

Priority will be given to scholarly papers that combine both empirical evidence and the legal context in a specific country.

This is an open access journal, ensuring maximum exposure and emphasizing citations. Publishing fees apply. All papers will be subjected to single blind peer-review.

This Special Issue is Jointly Sponsored with the Journal of Sustainable Real Estate
