This is an excellent piece of scholarship on an issue that is of serious concern to people everywhere. It will make a significant contribution to the already growing body of literature on this topic in many jurisdictions. I have nothing substantive to add and look forward to seeing it published.

The article lacks overall structure. It amounts more to a listing of severall thinkings and judicial cases than to a structured reflection on the issue handled here. It would not be in itself problematic if this way of doing was announced at the outset in the introduction.
It remains that, although presented in a somewhat disordered way, the elements analyzed (regulations, case law...) are interesting for the readers.

I have noted this reviewer's comments and made some minor revisions. Having regard to the very positive comments of the other reviewer, I have not altered the structure.
